Taking a transfer during your CA articleship, especially within the first year, is within your rights if you feel discomfort or believe another opportunity could better serve your career growth. Every principal may want you to stay for the benefit of the work you've done, but your career should be your primary focus. In this blog, I’ll share my personal journey through a transfer from a mid-sized CA firm to a top 10 firm, how it shaped my career, and tips on navigating challenges with principals who may try to stop you from leaving.

My Articleship Transfer Journey

I initially joined a mid-sized firm and gained a strong foundation over 9-10 months. However, after building skills and experience with various clients, I felt the need to move on to advance my career further. When I requested a transfer, my principal, like many others, tried to persuade me to stay, appealing emotionally and emphasizing my value to the firm. Many principals also resort to pressure tactics, using emotional appeals such as, "You're like family," or suggesting that you’ll be indispensable to the firm long-term.

If this doesn’t work, some principals may even try to forcefully stop you from transferring by delaying the No Objection Certificate (NOC) or refusing to sign necessary documents. In these cases, it’s wise to involve your parents. Taking them with you to discuss the matter can help clarify your intentions and show that you have their support, which may help your principal understand your resolve. If you are within your first year, you have a right to take a transfer without needing to provide reasons.  I decided to prioritize my career over sentiment and took the transfer after around 11 months—just before completing my first year.

Thinking Logically About Career Moves

Navigating these situations requires a logical approach. Your articleship is ultimately about building a foundation for your career. Making career decisions based on facts and your goals, rather than emotions, is essential. Many principals may feel they "planted the seed" of your skills and would like to see the fruits, but only you can take full responsibility for your career growth. In the first year, you are allowed to transfer without providing a reason, which gives you the freedom to move if you're not aligned with your current role or environment.


Reasons for Transfer After the First Year

If you're considering a transfer after the first year, ICAI guidelines outline specific grounds required for approval. Here are a few acceptable reasons:

  • Medical Grounds: A serious health issue requiring a minimum three-month break with supporting medical certificates.
  • Relocation: If your parent(s) are transferred to a city over 50 km away, with proof of the transfer.
  • Firm-Specific Changes: Situations like your principal ceasing practice, passing away, industrial training needs, or facing stipend payment issues.
  • Other Personal Reasons: Marriage, relocation, or pursuing the remainder of your articleship abroad.

Procedure for Articleship Transfer
  1. Discuss with Your Principal: Communicate your intention and reason for transfer with your current principal. It’s helpful to approach the conversation professionally and respectfully.
  2. Obtain Consent: Secure a No Objection Certificate (NOC) or consent letter from your current principal. This may involve some negotiation, especially if the principal is reluctant to let you go. If they refuse, consider bringing your parents with you to discuss the matter together.
  3. Find a New Principal: Identify a CA willing to take you on as an Articled Assistant and obtain a consent letter from them.
  4. Complete Necessary Forms:
    • Form 109: Used to terminate your Articleship with the current principal.
    • Form 120 (if applicable): Declaration for discontinuance of Articleship services.
  5. Prepare Supporting Documents: Gather any necessary supporting documents that validate your transfer reason, such as medical certificates or relocation orders.
  6. Submit to ICAI: Submit Form 109 and any supporting documents to the ICAI for approval if you’re in your second or third year. First-year transfers don’t require a reason, but submission to ICAI is still required for record-keeping.
  7. Await ICAI Approval: Once submitted, wait for ICAI’s approval, which can take a few weeks.
  8. Register with New Principal:
    • Execute a new Articleship deed with Form 102.
    • Register under the new principal using Form 103, submitted within 30 days of starting with the new principal.
